Last updated: 2026. These terms ("Terms") govern your access to and use of the NextGrow website, web application and farmer app (together, the "Service"). By using the Service you agree to these Terms. Where you use the Service on behalf of an organisation, you confirm you are authorised to accept these Terms for it. Specific commercial terms may be set out in a separate service agreement.
You agree to use the Service lawfully and only for its intended purpose. You must not misuse the Service, interfere with its operation or security, attempt to gain unauthorised access to any account or data, upload unlawful or harmful content, or use the Service to infringe the rights of others.
You are responsible for the accuracy of the information in your account and for keeping your credentials secure. You are responsible for activity that occurs under your account. Notify us promptly of any suspected unauthorised access. Access is governed by the roles and permissions configured by your organisation.
You must not copy, modify, distribute, decompile, reverse-engineer or attempt to derive the source code of the Service, or create derivative works from it, except to the extent this restriction is prohibited by applicable law.
We work to keep the Service reliable and available, but it is provided on an "as is" and "as available" basis. We may perform maintenance, update features, or suspend access where necessary to protect the Service or comply with law. We do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, NextGrow is not liable for any indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill, arising from your use of or inability to use the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them, without prejudice to any mandatory rights you may have under applicable law.
We may update these Terms from time to time. Material changes will be reflected on this page with a revised date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
